Terms of Sale

The following are our terms of sale for your purchase of design work. By making a purchase on our website for design work, you agree to abide by these terms of sale. Please take the time to read through the terms and to ask any questions prior to purchasing on our site. Whether you take the time to read them or not, the terms of sale are binding. We reserve the right to ammend our terms of sale at any time.

Copyright

All graphics, images, fonts and HTML on the work that we do is copyrighted by Molto Bella Designs. We retain full rights over all of our designs inlcuding the artwork, images, fonts and HTML. When you make a purchase for design services, you are purchasing a license to use our designs for ONE eBay store or website. The copyright for the actual design, graphics, etc. belongs to us. You are purchasing a license to use our design...you are not purchasing the ownership of that design. Our prices are much lower than our competitors as we have found that most folks only need a design for one purpose only.

What this means to you is that you cannot break up our designs, HTML or use our graphics for any other purpose other than what we designed it for...i.e. if you asked us to design a listing template, all of the design work that went into that listing template can only be used as a listing template in ONE eBay store only and must remain in tact as we provided it to you.

You cannot break up our work to make yourself a header or an About Me page or create a website (or any other web item or eBay store item) using our design work and graphics. If you need matching items, we're happy to make them for you and many are available on our website for purchase. If you don't see an item you need, please email us and we will be happy to provide you with a quote for the service.

If you need a license for unlimited use of our graphics and design work, please let us know and we will be happy to quote you a price.

Our copyright notice must remain in tact on all of the work we do for you. You cannot, at any time, remove our copyright notice from the items we create for you. Placing a link to us on a "credits page" is not acceptable.

If you purchase custom work from us, we will not resell the same design to another client. We do reserve the right to use the design for advertising purposes in our portfolio or for any other needs we deem necessary.

Our designs are non-transferable...you cannot share them with other people nor can you compile them on a CD for sale or sell them by any other means.

Web designers and graphic artists cannot use any of our copyrighted designs and/or graphics to create any items to match an item you've purchased without our written permission.

Refunds

Once work has begun on your project, there are no refunds. If you decide to cancel prior to work beginning on your project, there is a 25% cancellation fee.

Wait List

Because of our low prices and our award winning design services, we stay extremely busy. We normally have a wait list for our services. To get on the wait list, you just need to place and pay for your order and you will automatically be added. If you would like to know our current wait list time frame prior to ordering, please email us. Once you place and pay for your order, we will send you an approximate date of when we expect to start your project. The date will not be later than the date we quote you, but depending on how quickly we get through our other projects, we may be able to bump you up. We do accept rush jobs for a rush fee of $200 in addition to the cost of your project.

Please note that it is your responsibility to get all information back to us PRIOR to the quoted start date of your project. If we do not have your information by the start date, your project is removed from the project list and you will be added to the wait list again once you contact us. Failure to contact us within one month of your start date constitutes a failure to respond and a forfeiture of all funds paid.

Time to Design

The time it takes to complete the design work varies and is greatly dependent on you and your availability to remain in contact with us. Typically, if you are able to remain in close contact with us (i.e. if we send you an email with a proof, you are able to respond to us within a couple of hours) we are able to complete most eBay stores in 1 week and most websites within 2-3 weeks. That is typical, but is only an estimate....your project could take longer if there are special circumstances involved or if there is a delay in contact.

Photo Hosting

If you are purchasing eBay design work, whether is it custom work or pre-made work, you will need to have a place to host your images. Choosing a photo hosting company is your responsibility. There are a number of free services for photo hosting available on the web. We are happy to provide you with a few to check out if you need us to, but the ultimate decision of the company you go with is yours. We are not responsible for the company that you choose, their policies or how they operate.  Please make sure that the company you choose does not re-size or compress your images otherwise the quality of the images will be compromised.

Design Questionnaire

When you order and pay for your project, we will send you a design questionnaire to capture your ideas of what you'd like to see for your project. It is absolutely crucial that you think through your answers on this questionnaire as it is what we use to create your design. Please complete the questionnaire in full and as specific and concisely as possible.

It is also very important that you take the time to look through various eBay stores and/or websites to provide us with some examples that you like. That gives us a great visual of what you're looking for. If you are not clear and detailed in the questionnaire, you may not get what you're looking for so please make sure to take time and carefully answer each question.

Images

We will also ask you to include all images you would like used in the creation of your design. You will need to provide the images in .jpg or .gif format. For example, if you would like a category format for your store front, you will need to provide one image for each category you would like featured on your store front.

If you have good images in your store, we can often use those in the design. If your images are not professional looking (they don't have to be done by a professional, but they do need to be professional looking) they cannot be used. We will, at that point, ask you if you have other images of your items available. If you do not, you can purchase stock photos from stock imaging sites such as istock or dreamstime for a minimal fee. Providing good images is the client's responsibility. If you prefer that we locate the images for you, we are happy to do that for a fee.

We will need the user id and password to your photo hosting account in order to upload your design images to it.

Revisions

We allow for two sets of revisions per item purchased (for a complete eBay store, you get two revisions per store item, i.e. two revisions for the logo, two for the about me page, two for the store front, etc). We will create the item based on what you've told us in the design questionnaire and send you a proof of the design we have created. From there, you can let us know if there are any changes that you would like to that proof. We will make the revisions you've requested and send you another proof. You, again, will have the option to let us know if you want anything else changed. Once we hear back from you the second time, we will make the additional changes you've requested and the item is complete and loaded to your eBay store or website. It is critical that you are very specific and detailed in the revisions you would like made. For instance, "I don't like the font" is not very specific. "I don't like the font, but I would like this font instead" is specific.

Once you approve the design, it is coded and uploaded to your store. There are no additional revisions after your approval even if you didn't use the two revisions that were available to you. It is very important that you provide us with your revisions PRIOR to giving us your approval of the design. Revisions required after this point are billed at our hourly rate of $55 per hour.

If additional revisions are needed, they will be billed at our hourly rate of $55 per hour. We will be happy to give you a quote on how much time it will take for your additional revisions prior to doing the work (beyond the two that are included), however, the fee must be paid prior to the extra revisions being done.

There are no revisions on pre-made listing templates or pre-made eBay stores. These items are sold "as-is". Your business name will be added (if appropriate) and the template will be coded to your information. No other changes will be made. Please do not ask if we can change the colors or fonts or designs on a pre-made template....at that point it is custom work and no longer a pre-made design.

Uploading Designs

The cost of uploading the designs we create to your website or eBay store is included in the price of the work. In order to do so, we will need your eBay user id and password for an eBay store or your FTP information for a website.

If you would prefer to upload the designs yourself, you are more than welcome to and we will provide you with the coding for each page. We will not, however, provide instructions, tutorials or training of how to upload pages to eBay so please make sure you know how to do this prior to trying. We will not be held accountable for any damage you do to the coding in this process and if you do break the code, there will be a charge to fix it.

Support

Support for eBay stores is provided for one week after the design has been uploaded to your store. We will provide instructions on how to use the listing template. All support is given via email for eBay stores.

Support for websites is provided by two 2 hour training sessions so we can train you on how to use your new website. The cost for the training sessions is included in the purchase price of the website. After the training sessions, we will provide support for two weeks after the second training session via email.
